Terms of Service

1. Agreement
These Terms of Service ("Terms") govern the use of the Altura Fundraising platform ("Platform") operated by Altura Media Ltd ("we", "us", "our"), a company registered in England and Wales under company number 16752254, VAT registration number 505643406, with its registered office at 86-90 Paul Street, London, Greater London, England, EC2A 4NE.
By using this Platform - whether as a foundation receiving donations or as a donor making a contribution - you agree to be bound by these Terms.
2. Definitions
- "Platform" means the Altura Fundraising donation system, including the website at alturamedia.site, embeddable donation widgets, the foundation admin dashboard, and all associated APIs and subdomains.
- "Foundation" means a registered nonprofit organisation, charity, or foundation that has been onboarded onto the Platform to receive donations.
- "Donor" means any individual or entity that makes a financial contribution through the Platform.
- "Handling Fee" means the percentage deducted from each donation to cover Platform operation, payment processing, and ongoing maintenance.
- "Stripe Connect" means the payment infrastructure provided by Stripe that enables donations to be processed and funds transferred to Foundations.
3. Platform Description
Altura Fundraising is a donation collection platform that enables Foundations to accept online donations through an embeddable widget on their websites. The Platform supports card payments (Visa, Mastercard), Apple Pay, Google Pay, Revolut Pay, Stripe Link, and recurring donations.
We act as a technology provider and payment facilitator. We are not a charity, foundation, or financial institution. Donations are made directly to the Foundation via Stripe Connect. At no point does Altura Media Ltd hold or have access to donated funds.
4. Foundation Terms
4.1 Eligibility and Onboarding
Foundations must be legally registered nonprofit entities in their country of operation. Onboarding requires completion of Stripe Connect identity verification (KYC), provision of valid registration and tax documentation, and agreement to these Terms.
4.2 Handling Fee
A Handling Fee of 10% is deducted from each donation before funds are transferred to the Foundation. This fee covers Platform operation, hosting, ongoing development, and support. Stripe's own payment processing fees are charged separately by Stripe and deducted before the Handling Fee calculation. The Handling Fee percentage may be adjusted with 30 days' written notice.
4.3 Fund Transfers
Donations are transferred to the Foundation's connected Stripe account on a weekly or biweekly schedule, as agreed during onboarding. Transfers are subject to Stripe's processing times and any holds that Stripe may apply for risk management purposes. We are not responsible for delays caused by Stripe or the Foundation's bank.
4.4 Foundation Obligations
Foundations agree to:
- Use donated funds exclusively for their stated charitable purpose.
- Maintain valid and current registration as a nonprofit entity.
- Comply with all applicable laws and regulations regarding charitable donations, including tax reporting and donor receipt obligations.
- Not use the Platform for any fraudulent, illegal, or misleading activity.
- Provide accurate and up-to-date information for Stripe verification and Platform administration.
5. Donor Terms
5.1 Donations
By making a donation, you acknowledge that your contribution is voluntary and made to the specific Foundation identified at the point of payment. Altura Media Ltd is a technology provider and is not the recipient of your donation.
5.2 Payment Processing
All payments are processed securely by Stripe. Your payment card details are handled directly by Stripe and are never stored on or transmitted through our servers. By completing a donation, you authorise Stripe to process the payment on behalf of the Foundation.
5.3 Recurring Donations
If you set up a recurring donation, you authorise Stripe to charge your selected payment method at the agreed frequency (e.g. monthly) until you cancel. You may cancel a recurring donation at any time - see our Refund Policy for details.
5.4 Tax Receipts
Donation receipts and tax documentation are the responsibility of the receiving Foundation, not Altura Media Ltd. If you require a receipt for tax purposes, contact the Foundation directly.
6. Intellectual Property
All intellectual property rights in the Platform - including source code, design, widget technology, APIs, and branding - are and remain the exclusive property of Altura Media Ltd. Foundations are granted a non-exclusive, non-transferable licence to embed the donation widget on their websites for the duration of their active agreement.
7. Platform Availability
We target 99.9% uptime on an annual basis but do not guarantee uninterrupted service. We are not liable for downtime caused by third-party infrastructure failures (Stripe, Vercel, Cloudflare), scheduled maintenance with advance notice, force majeure events, or actions by the Foundation such as incorrectly configured widget embedding.
8. Termination
8.1 By Foundation
A Foundation may terminate its agreement at any time by providing 30 days' written notice to pallayfarkaszoltan@gmail.com. Any pending donations will be processed and transferred before the account is closed.
8.2 By Us
We may suspend or terminate a Foundation's access immediately if: (a) the Foundation breaches these Terms; (b) fraudulent or illegal activity is suspected; (c) Stripe suspends or terminates the Foundation's connected account; or (d) the Foundation loses its nonprofit registration.
8.3 Effects of Termination
Upon termination, the donation widget will be deactivated, the Foundation's admin dashboard access will be revoked, and any outstanding fund transfers will be completed. Donation transaction records will be retained in accordance with our Privacy Policy.
9. Limitation of Liability
To the fullest extent permitted by law, Altura Media Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the Platform. This includes but is not limited to loss of donations, loss of data, loss of reputation, or business interruption.
Our total aggregate liability shall not exceed the total Handling Fees retained by us in the 12 months preceding the event giving rise to the claim.
We are not responsible for: the charitable activities or conduct of any Foundation, the accuracy of information provided by Foundations, how Foundations use donated funds, or any disputes between Donors and Foundations.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under English law.
10. Dispute Resolution
Disputes between Donors and Foundations regarding how donated funds are used must be resolved directly between those parties. Altura Media Ltd is a technology provider and does not mediate such disputes.
For disputes relating to the Platform itself, both parties agree to first attempt good faith negotiation. If unresolved within 30 days, either party may pursue legal proceedings.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, regardless of the country of residence of the Foundation or Donor.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to registered Foundations via email with at least 30 days' notice. Continued use of the Platform after changes take effect constitutes acceptance.
